Terms of Service

Please read these Terms of Service ("Terms") carefully before accessing or using HiveLuma (the "Service"). Registration and continued signed-in product use require explicit acceptance of these Terms and the Privacy Policy. Account recovery, security, deletion and necessary support remain available without accepting an update.
1. Acceptance of Terms
If you are entering into these Terms on behalf of an agency, company, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms. You acknowledge that acceptance of these Terms and our Privacy Policy is required in order to register for and use the Service.
2. Description of Service
HiveLuma is a B2B SaaS platform that helps users understand how brands appear in AI-generated answers and identify ways to improve that visibility. The Service may use artificial intelligence, machine learning systems, and large language models to process data, evaluate digital presence, generate schema-related outputs, and provide comparative insights, recommendations, and related reporting.
3. Use of Service, Credits, and Restrictions
Subject to your compliance with these Terms, HiveLuma grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes and, where applicable, for client-facing business use.
- Credit lifecycle. Monthly plan credits, including AI credits and Trusted Names (TN) credits, do not roll over. Paid plan allowances renew with a verified paid billing period. Starter allowances refresh every 30 days. Purchased top-up credits survive renewals and cancellation, but spending them requires eligible paid plan access. They do not restore plan access during a billing failure. Failed paid actions may receive an exact credit refund under the Service's billing rules; completed usable reports remain charged.
- Bring Your Own Key (BYOK) and fair usage. BYOK means using your own AI provider keys. It requires eligible plan access (Growth at launch). Your eligible workspace can use up to 1,000 BYOK runs each verified billing period. One scan or supported tool run counts as one run, even when HiveLuma uses several AI providers. Retries, recovery and follow-up work inside that run do not use extra runs. Once work starts, the run counts even if it later fails or receives a credit refund. A reserved run can be released only when HiveLuma confirms the work did not start. Your AI providers may charge you separately. Included and purchased AI credits are used before BYOK where supported. Trusted Names still uses TN credits, plus one BYOK run when it uses your keys. Not every tool supports BYOK. AI/TN credit top-ups do not increase this limit; there is no BYOK quota top-up. If your current billing period cannot be verified, BYOK cannot start. Saved keys remain while eligible plan access continues, including before a scheduled cancellation takes effect. Eligible-plan changes preserve keys; loss of BYOK access deletes them. Regaining access requires key re-entry.
- Restrictions. You agree not to reverse engineer, decompile, copy, scrape, or otherwise misuse the Service; use the Service or its outputs to build a competing product; interfere with the integrity or security of the Service; or attempt to circumvent plan limits, access controls, usage caps, billing logic, or technical protections.
4. Intellectual Property and Data Use
All rights, title, and interest in and to the Service, including its software, interfaces, designs, workflows, algorithms, scoring systems, and related technology, remain the exclusive property of HiveLuma and its licensors. Except for the limited rights expressly granted under these Terms, no rights are granted to you by implication or otherwise. You retain ownership of the raw data and materials you submit to the Service, subject to the rights granted below.
Data license grant. By using the Service, you grant HiveLuma the rights needed to host and process Customer Data while providing the Service. Customer artifacts follow the retention period associated with the effective plan and are purged when eligible. HiveLuma may use separately aggregated or irreversibly de-identified information for service analytics and research, but detached raw customer reports are not treated as anonymous.
5. Limitation of Liability and Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HIVELUMA DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
YOU ACKNOWLEDGE THAT THE SERVICE MAY QUERY OR RELY UPON THIRD-PARTY ARTIFICIAL INTELLIGENCE MODELS, DATA SOURCES, AND SYSTEMS TO GENERATE ANALYTICS, INSIGHTS, RANKINGS, RECOMMENDATIONS, AND RELATED OUTPUTS. SUCH OUTPUTS ARE PROBABILISTIC IN NATURE AND MAY CONTAIN HALLUCINATIONS, INACCURACIES, OMISSIONS, BIASES, OR OTHER ERRORS THAT ARE NOT CONTROLLED BY HIVELUMA. HIVELUMA DOES NOT WARRANT THE ACCURACY, COMPLETENESS, RELIABILITY, OR FITNESS OF ANY AI-GENERATED OR THIRD-PARTY OUTPUT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HIVELUMA, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, BUSINESS OPPORTUNITY, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE SERVICE OR YOUR USE OF, OR INABILITY TO USE, THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, LOSSES OR BUSINESS DECISIONS ARISING FROM MARKETING, STRATEGIC, OR OPERATIONAL ACTIONS TAKEN IN RELIANCE ON SERVICE OUTPUTS.
6. Indemnification
You agree to defend, indemnify, and hold harmless HiveLuma, its affiliates, officers, directors, employees, contractors, and agents from and against any claims, actions, demands, liabilities, damages, judgments, losses, costs, and expenses, including reasonable legal fees, arising out of or related to your access to or use of the Service, your Customer Data, your violation of these Terms, or your violation of any applicable law or third-party right.
7. Termination and Grace Periods
HiveLuma may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, created risk for the Service or its users, or used the Service in a manner that is unlawful, abusive, fraudulent, or operationally harmful. If you cancel a paid subscription during an active billing cycle, any grace period, downgrade treatment, or continued access to remaining plan benefits shall be governed by your then-current plan rules and billing policies. Unless otherwise stated by HiveLuma, cancellation does not entitle you to a refund for partial billing periods.
8. Governing Law
These Terms and any dispute arising out of or relating to these Terms or the Service shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
9. Data, AI providers and deletion
HiveLuma may send relevant submitted content or public-page content to supported AI providers for the analysis you request. Providers may receive different inputs. Provider terms govern their own retention, training and deletion practices; we do not promise that this request erases provider-held copies. AI results can be wrong, incomplete or limited by unavailable providers. They are not proof of trust, accuracy, market leadership or guaranteed visibility. Review results before using generated code or taking action.
Public Page Scan results are kept for up to 30 days after they are ready. Linked identifiable lead and event information is kept for up to 90 days from creation. New scans may use external AI providers. A saved result may be reused without another AI call. Consent evidence currently follows that lead/event lifecycle, not a separate longer-lived archive.
Deletion removes eligible HiveLuma-held content. Required billing and security evidence, and some shared-workspace records, may remain. Downloads, external/provider copies, and infrastructure logs or backups are not erased by this request. Billing shutdown or content removal may remain pending. Active work must finish before a report can be removed. An account owner must resolve other workspace memberships before account deletion.
Analytics is optional and your choice applies to that browser, not your whole account. “Do not allow” stops future HiveLuma-triggered analytics there. It does not erase data already received by Google or another analytics provider. Sensitive account and private link-access routes are excluded.
